You are responsible for the Content in your Products, including any images, text, or materials. Ensure you have permission for any third-party content to avoid infringing on rights such as copyright or trademark. By placing an order, you confirm you have the necessary permissions and authorize us to produce your Products.
You must follow local rules on online conduct and avoid uploading unlawful or inappropriate Content. We are not liable for any offensive or objectionable Content.
Safeguard your account and be aware that any orders placed through it grant us a license to use your Content for design storage and print orders.
TopUSAPackaging may remove Content that violates the terms of service and may disclose Content to meet legal requirements or protect rights and safety.
Customer-Provided Artwork and Design Files
The original artwork should be provided with a minimum resolution of 300 DPI (bits/inches) also in a CMYK format. We will not be accountable for any other format conversions to CMYK and pictures that may seem pixelated, blurry, defected or distorted due to customer summitted original artwork. By the time you post your artwork or files on our website, you ensure that the published material is your property as required by law.
The lowest resolution design files provided by us are of 72 DPI. In order to get higher resolution design files, kindly contact us by our website.
Indemnification and Limitation of Liability
You agree to indemnify and hold TopUSAPackaging, including its management, employees, agents, and representatives, harmless from any claims, liabilities, or damages arising from any inaccurate representations or harmful actions by customers.
If you fail to meet these obligations, you agree to assume full responsibility for any resulting damages or liabilities incurred by the company as referenced by the client.
This includes, but is not limited to:
- Unauthorized access to our website resulting in any harm or damage.
- Any offensive or inappropriate actions taken by associated parties.
- Losses, damages, or fraud stemming from your actions or omissions.
You also agree to cover all relevant legal fees and royalties associated with these issues, ensuring the company is fully protected from any related claims.
TopUSAPackaging will not be held liable for any accidents, fatalities, damages, or losses incurred by our employees, marketing staff, media personnel, or contractors resulting from the use of our website or the information provided therein.
In no event will our total liability to you for any claims, damages, or causes of action arising from this agreement or your use of our website exceed the total amount paid by you to TopUSAPackaging for your order.
Proofing, Hard Copy & Color Matching
Customers must approve the final artwork and job specifications via email. It’s your responsibility to review all details, including delivery dates and production speed. TopUSAPackaging is not responsible for discrepancies beyond the final specifications or errors not identified by you.
Print the proof at one hundred percent size to check for accuracy. We cannot guarantee color matching or ink density from screen proofs. We will try to match colors in duo-tone prints, but changes due to lamination are not our responsibility. For exact color matching, request a color match proof.
TopUSAPackaging strives to reproduce colors from submitted print-ready files as accurately as possible. However, we cannot guarantee exact color matching or density due to limitations in printing processes and varying properties of different surfaces. A hard copy proof needs to be ordered at extra cost in order to ensure perfect color reproduction. TopUSAPackaging is not accountable for color variations between submitted files and the final printed product.
Customer Responsibility for Proof Approval
Please be aware that the paper or cardstock used for our products is not food-grade. If you require food-grade materials, notify us in writing before placing your order. It is also the customer’s responsibility to review and approve proofs and layouts before printing. TopUSAPackaging is not accountable for errors resulting from:
- Incorrect font usage
- Graphics orientation or placement issues
- Grammar, spelling or punctuation mistakes
- Incorrect die cuts, slits, or missing folds
- Incorrect finished product size
Request Cancellation
TopUSAPackaging reserves the right to cancel your request before printing or delivery. However, once your item has been shipped, cancellation is no longer possible. Orders may be canceled at various stages of production, but cancellation fees will apply. Our Customer Support Team will let you know about any costs that may apply..
- Orders are submitted online.
- Orders are worked on in our planning division.
- Orders are shipped off the print machine.
- Orders are packed by the shipping division and delivered.
Return and Refund Policy
Assuming that you observe any inadequacy in the printing of your item or the item isn’t printed by your determinations, you need to inform us within 3 working days right after accepting your solicitation. If there should be an occurrence of imperfect printing or not outright printing, we would react as needs be, notwithstanding, don’t restrict the expense.
Defect checking is completed by our experts. The clients need to send the imperfect item’s photographs to TopUSAPackaging using their own use in 7 working days. Rush orders have non-refundable charges.
Production Speed, Delivery, and Order Shipping
When you submit full payment for your order to TopUSAPackaging, provide your artwork either in hard copy or digital format. Once received, the press department will review and production will commence. The production speed and press cycle will start from this point.
You can select the production speed on our website, which indicates the number of business days from printing to shipping. We strive to produce and deliver on schedule. However, we are not responsible for delays caused by weather or customs issues beyond our control.
If there are issues with the print cycle, costs are limited to the extent of the delay, but you will need to cover any additional expenses incurred. Any taxes or fees for shipping to areas where customs are involved are your responsibility. Additional charges apply for shipping to non-standard locations, and we are not liable for any damages or delays during shipping.
If there are errors in the shipping address you provide, or if a different address is specified, you will incur extra charges for both shipping and return.
Warranty Clause
Without any explicit or implicit warranties of any sort, the website and its contents are offered just as is. This covers, among other things, the following: merchantability, suitability for a certain purpose, and non-infringement. You understand that there’s a chance the website won’t always work properly or be available. The website’s references to and links to third-party goods and services are also offered without any kind of implied or express warranty.
